Under UK data protection law, we must have a lawful basis for processing personal information. The basis we rely upon depends on the particular processing activity.

Contract

We may process personal information where necessary to take steps at your request before entering into a contract or to perform a contract with you.

This may apply to client services, campaigns, creator or talent arrangements, collaborations, freelance work and other commercial relationships.

Where we rely on consent, you may withdraw it at any time.

Legal Obligation

We may process personal information where necessary to comply with legal, regulatory, tax, accounting or other obligations that apply to us.

We aim to share only the personal information reasonably necessary for the relevant purpose.

10. Service Providers

We use third-party services to help operate Dynasty Creative.

Squarespace

Our Website is hosted and supported by Squarespace.

Squarespace may process personal information in connection with Website hosting, security, analytics, forms and related functionality. Further information about its processing practices is available in the Squarespace Privacy Policy.

Google

We use Google services, including Gmail and Google Drive, for business communications, file storage and administration.

Personal information contained in correspondence, project materials and other business files may therefore be processed using Google services.

Canva

We use Canva for creative work and certain business documents, including invoices and agency materials.

Where documents or materials contain personal information, that information may be processed through Canva's services.

We may change service providers as our business develops. Where a change materially affects how personal information is processed, we will update this Privacy Policy where appropriate.

11. International Transfers

Some organisations we work with and some of our service providers operate outside the United Kingdom. We may also work with clients, brands, agencies, creators and other professional contacts located internationally, including in the United States.

Personal information may therefore be transferred to or processed in countries outside the UK.

Where a transfer is subject to UK international data transfer restrictions, we will take appropriate steps to ensure that a lawful transfer mechanism or safeguard applies.

Depending on the circumstances, this may include:

  • UK adequacy regulations or an applicable UK data bridge;

  • the International Data Transfer Agreement;

  • the UK Addendum to the EU Standard Contractual Clauses; or

  • another transfer mechanism or exception permitted under applicable UK data protection law.

Where a service provider processes personal information on our behalf, we rely on the applicable contractual and international transfer safeguards provided under our arrangements with that provider.

For further information about safeguards relevant to a particular transfer, contact mason@dynastycreative.co.uk.

12. Data Retention

We keep personal information only for as long as reasonably necessary for the purposes for which it was collected, taking into account applicable legal, contractual, accounting and tax requirements.

As a general guide:

  • General enquiries and correspondence: normally up to 2 years following the last meaningful interaction where there is no continuing reason to retain them.

  • Prospective clients and professional contacts: normally up to 2 years following the last meaningful interaction, subject to review and unless an ongoing relationship or another legitimate reason requires longer retention.

  • Creator, talent and freelance applications or expressions of interest: normally up to 2 years so that we can consider individuals for relevant current or future opportunities.

  • Active client, creator, campaign and project records: for the duration of the relationship and afterwards for as long as reasonably necessary for contractual, legal, administrative and record-keeping purposes.

  • Financial, invoicing, payment and tax records: for the period required by applicable tax, accounting and legal requirements.

  • Marketing suppression information: for as long as reasonably necessary to ensure that an opt-out or objection continues to be respected.

We may retain information for longer where reasonably necessary to establish, exercise or defend legal claims, resolve disputes, investigate suspected wrongdoing or comply with a legal obligation.

When information is no longer required, we will delete, anonymise or securely dispose of it where appropriate.

13. Cookies and Analytics

Our Website uses cookies and similar technologies.

Certain functional and required cookies may be used to enable Squarespace to securely provide and operate the Website.

Where enabled, analytics and performance technologies may process information including:

  • browser, network and device information;

  • IP address;

  • pages visited;

  • referral information;

  • clicks and internal links;

  • scrolling;

  • searches; and

  • timestamps.

We use this information to understand Website traffic, usage and performance and to improve the Website.

Where consent is required by applicable law, non-essential cookies and similar technologies will not be used until the necessary consent has been obtained.

You can manage applicable preferences through our cookie banner or cookie settings and may also be able to control cookies through your browser.

Please see our Cookie Policy for further information.

However, no internet transmission or electronic storage system can be guaranteed to be completely secure.

16. Your Data Protection Rights

Depending on the circumstances, UK data protection law may give you rights including:

  • Right of access: to request a copy of personal information we hold about you and certain information about how it is processed.

To exercise an applicable data protection right, contact mason@dynastycreative.co.uk.

If you believe that someone under 18 has provided personal information to Dynasty Creative, please contact mason@dynastycreative.co.uk.

18. Automated Decision-Making

Dynasty Creative does not currently make decisions about individuals based solely on automated processing, including profiling, where those decisions produce legal or similarly significant effects.

If this changes, we will update this Privacy Policy and provide any additional information required by law.

19. Complaints

If you have a concern or complaint about how Dynasty Creative has collected, used, stored, shared or otherwise handled your personal information, please contact mason@dynastycreative.co.uk.

We will acknowledge a data protection complaint within 30 days of receiving it, take appropriate steps to investigate it and communicate the outcome in accordance with applicable data protection law.
